This Terms of Use agreement (the “Agreement”) governs your access to and use of the Site. This Agreement may be modified at any time without prior notice by Global India Collective (“GIC,” “we,” “us,” “our”) by posting the modified Agreement to the Site. Any such modifications shall be effective immediately upon posting unless some other effective date is expressly stated. Your continued use of this Site shall constitute and be deemed your unconditional acceptance of this Agreement and any changes to this Agreement.
Your use of the Site is also governed by our Privacy Policy, which is hereby incorporated into this Agreement. Please review our Privacy Policy here. We reserve the right, and you authorize us, to use and assign all information provided by or collected from you in any manner consistent with our Privacy Policy. In addition, when using our Site, you shall be subject to any posted policies, guidelines or rules applicable to use of the Site and any service provided by or on the Site. All such policies, guidelines and rules are hereby incorporated by reference into these Terms of Use.
Site Content.The Site is provided on an “as is” basis and may use internet services that are not under our direct control. While we strive to provide accurate descriptions of our content and services, we do not warrant that the descriptions, or other content on the Site are accurate, complete, or current. We reserve the right to correct errors. We do not warrant that the Site or its features will be accessible at all times or that it will function in an error free manner. We reserve the right to cease operating the Site or any of its features at any time.
Intellectual Property. All content on this Site including without limitation graphics, logos, trademarks, images, and software is, and shall continue to be, the property of GIC, its assignees, or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site. If you submit any information, materials, ideas, comments, photos or other content to us (the “User Content”) through the Site, social media communities, survey responses, email or otherwise, you grant us a worldwide, irrevocable, royalty-free, perpetual, transferable, license to use, reproduce, modify, adapt, create derivative works from, publish, translate, display and sublicense the User Content, in whole or in part, in any format and on any platform either now known or hereinafter invented, and to associate the User Content with your name and/or likeness. You are solely responsible for your User Content. You represent that you have the right to submit the User Content to us and the right to grant us the license described above. You warrant that the User Content is accurate and not misleading, and our use thereof, does not and will not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy right of any party or individual.
Site Use. The Site is for your personal and non-commercial use, unless otherwise specified. You may not use any contents or service provided by the Site for any other purpose, including any commercial purpose, without the prior express written permission of an authorized representative of GIC. You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer, sell, reverse engineer, hack into, or otherwise infringe on any intellectual property rights related to any information, content, software, products or services obtained from or otherwise connected to the Site. Your use of this Site is at our sole discretion, and we may terminate your access and use at any time without prior notice or liability for any reason whatsoever. You agree not to:

Links to Other Sites. The Site may provide links to other websites. The Site’s Terms of Use or Privacy Policy may not apply to those other websites, which may have their own terms and policies. You should review the terms of use and privacy policies of any other websites that you visit. The inclusion of a link should not be taken to mean endorsement by GIC of the linked site.
Compliance with Laws.You agree to comply with all applicable laws regarding your use of the Site. If you are outside the United States you must comply with all local laws with respect to your online conduct, as well as the export of data to the United States or to your country or residence. You further agree that information provided by you is truthful and accurate to the best of your knowledge.
You agree to indemnify and hold GIC, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of this Agreement by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any content or information or service accessed from the Site.
YOUR USE OF THE SITE IS AT YOUR OWN RISK. ANY SERVICE AND/OR INFORMATION PROVIDED BY THE SITE IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. GIC DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. GIC DOES NOT WARRANT THAT ANY FUNCTION OR CONTENT CONTAINED ON THE SITE OR ANY SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE, OR THE RESULT OF USE, OF ANY SERVICE OR CONTENT IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE. Limitation of Liability. GIC, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, LOSS OF DATA, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF GIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, SUCH DAMAGES WERE REASONABLY FORESEEABLE OR GIC WAS NEGLIGENT. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF GIC AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE), EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID TO GIC FOR THE USE OF THE SITE OR ANY SERVICE IT PROVIDES. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions, our liability is limited to the maximum extent permitted by law.
Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to us:
1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2. A description of the copyrighted work that you claim has been infringed;
3. A description of where the material that you claim is infringing is located on the Site;

Applicable You agree that the laws of the state of Washington without regard to conflicts of laws provisions will govern this Agreement and any dispute that may arise between you and GIC or its affiliates. Venue shall be the state and federal courts located in King County, Washington. You agree to personal and exclusive jurisdiction by and venue in the state and federal courts of the King County, Washington.
If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
Relationship of the Parties. Each party is, and shall remain, an independent contractor and nothing contained in this Agreement shall be construed to make either party a partner, joint venturer, employee or agent of the other party, and neither party shall hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party.
